Their answer was: Yes, they do. These right of way, known as easements, enable property owners to walk across another's property in order to get to their own.

Spoke to a lawyer today. He says if we can prove that there a point where the path was made for this estate we can clam it. Also if we can show that it is vital to us eg fire escape we can also clam it back.
ReplyDeleteHe also advice that we should form a collective, each contribute a small amount and then take them to court.
I think that this might be a good recourse as our MP seems to have her hands tied.
What you got to realize is govt agencies such as HDB and MND and LTA were the ones responsible for including that footpath within their boundaries. The land swap alternatives were not favoured by HDB even when the HUDC residents only wanted a swift completion of the privatisation process. Legal privatisation of an HUDC estate can be completed only after a new land title is issued by the Strata Titles Board. The privatised estate has legal ownership of the land. It's highly unlikely anyone in the govt will reverse this for that would be an admission of their mistakes.
